During your search for an attorney, you may come across an attorney who has been subjected to discipline by his bar association for misconduct. In years past, potential clients might only have become aware of this from the rare news story [FN 1] ), or perhaps by being the rare go-getter energetic enough to review a bar association’s disciplinary records. Then came the internet. And more recently, Avvo.
Avvo is one of the more prevalent lawyer rating services. [FN 2] The significant difference between Avvo and most other services is that it posts any form of bar discipline front and center on the lawyer’s profile. And it does so with the level of subtlety that only prominently displayed BRIGHT RED can bring to bear. Some poor sap of a lawyer who stubbed his toe and suffered a mild slap-on-the-hand reprimand 20 years ago is left to wear the red badge of shame on Avvo.
Here’s your concern, there is a broad spectrum of disciplinary levels, and there are excellent lawyers who have been disciplined at some point during their careers. If you have been referred to an attorney who has been disciplined, and you are otherwise interested in him, don’t let the fact that he has been disciplined stop your consideration. Find out what happened.
I practice in Oregon. Our range of disciplinary actions runs from a relatively mundane discipline action of reprimand to the licensing “death penalty” of disbarment. You probably won’t find too many disbarred lawyers still on the market, but you may come across someone who has been reprimanded or suspended for some odd reason.
